VIAJES ALAMEDA, S.A. Terms and Conditions

A) PRESENTATION

VIAJES ALAMEDA, S.A. is a company governed according to current Spanish legislation.  The company's registered office is in Benidorm as is it's main operating base at Vía Emilio Ortuño, 15, Alicante, Benidorm, Spain.

VIAJES ALAMEDA, S.A. is registered with the Mercantile Register of Alicante, volume 480, book 184 of section 3 of the Corporations Register, folio 176, sheet 2,683, entry 1, and Tax Identification Number ES-A03078318.

VIAJES ALAMEDA, S.A. also trades as "SHUTTLE DIRECT", which it fully owns.

In addition to the aforementioned address, VIAJES ALAMEDA, S.A. and the trademark "SHUTTLE DIRECT" have the appointed use of the telephone number (+34)966830101 and fax number (+34)965856551, and operate through the following websites: www.viajesalameda.com and www.shuttledirect.com, with e-mail address customer.care @ viajesalameda . com

Please ensure you have read and understood the contract conditions that will govern any future contract prior to requesting a service offered electronically on the VIAJES ALAMEDA, S.A. websites.

If you do not understand or comprehend any of the contract conditions, it is recommended that you do not continue with the contract and contact Customer care.  

B) SERVICES
 
I. Through its websites, VIAJES ALAMEDA, S.A. offers services as an agent for the contracting of transfers for individuals or groups as well as tourist accommodation.

II. These services are performed as an agency.  The company only acts as a direct supplier in exceptional circumstances, which shall be duly notified to the customer.

III. When you enter into an agreement, VIAJES ALAMEDA, S.A. shall administer the formalities required to contract the transfer or accommodation service.  This contract shall only be understood as confirmed once the service supplier consents and thus notifies the customer of VIAJES ALAMEDA, S.A.

C) ONLINE CONTRACTING PROCEDURE 

I. VIAJES ALAMEDA, S.A. offers a range of services for which the suppliers have notified their availability.

II. The customer requests one or more of the aforementioned services offered via the websites of VIAJES ALAMEDA, S.A., authorising their credit card to be charged for the corresponding amount of the offer, without this entailing effective close of the agreement.

III. VIAJES ALAMEDA, S.A. confirms the possibility of providing the service with the service supplier and, if the latter party provides consent, the client is notified of service confirmation via e-mail.  At this time the agreement is understood as effectively closed. If the service supplier refuses to provide the service, the customer shall be notified and their credit card reimbursed with the amount charged.

IV. All notifications made by VIAJES ALAMEDA, S.A. shall require acknowledgement of receipt by the customer.  However, should the customer fail to acknowledge receipt of an e-mail, the records that exists on VIAJES ALAMEDA, S.A. e-mail server  shall be proof enough of reception.

V. VIAJES ALAMEDA, S.A. shall likewise send the customer confirmation of charges and payments made through the credit card with which the service has been paid.  Under no circumstances shall this entail effective close of the contract.

VI. The e-mail confirmation of service provision carried out by VIAJES ALAMEDA, S.A. shall enable you to access your voucher, which you must print out and preserve during your trip and present to the VIAJES ALAMEDA, S.A. representative during the outbound and/or return journey and to the service suppliers during the trip, if these are transfers, or at the designated hotel or apartment check-in desk, in the case of accommodation.

VII. VIAJES ALAMEDA, S.A. recommends customers to print the voucher, the service request and the confirmations, along with any other communication carried out between both parties.

VIII. VIAJES ALAMEDA, S.A. likewise recommends its customers and website users to read all the terms and conditions of the offers in detail, along with the details of the reservation and confirmations, and to make sure that the terms of their requests meet their interests, given that these details comprise the object of the contract for service provision.  Please also make sure you have filled in all of the compulsory fields marked as such on the service request form.  

D) LANGUAGES

I. VIAJES ALAMEDA, S.A. websites are available in multiple languages.  Every effort shall be made to ensure that the Customer care helpdesk and e-mail assistance are available in the language contracted.  However, Customer care can only be guaranteed in Spanish and English.

II. VIAJES ALAMEDA, S.A. oversees the quality of the translation of its websites and Terms & Conditions; however, in the event of any discrepancy, the Spanish version shall prevail.


E) LIABILITY OF VIAJES ALAMEDA, S.A.

I. The reservations requested through these websites are contracted directly with the company providing the transfer or accommodation service and not with VIAJES ALAMEDA, S.A. Therefore, the liabilities resulting from this agreement shall be limited to those of a third-party broker between the customer and supplier; the liabilities resulting from the provision of the transfer or accommodation service shall fall to the company providing this service and their insurance companies.

II. Some suppliers may have additional contract conditions. VIAJES ALAMEDA, S.A. acts as an agent for each transfer or accommodation supplier by providing this party with the online booking service.  The liability of VIAJES ALAMEDA, S.A. is restricted to providing the service supplier with the booking details as entered in our website. VIAJES ALAMEDA, S.A. is not liable for losses or damages that may occur through the incorrect processing of your reservation details by the service supplier. 

III. VIAJES ALAMEDA, S.A. is not liable for incidents that may occur in the rendering of the service, more specifically illnesses, personal injuries or death, unless caused by our negligence. Any compensation for accident, illness or death resulting from the use of the transfer or accommodation service must be addressed to the direct supplier of that service and shall be subject to the laws and to the jurisdiction of the country in which the service is effectively provided.

IV. VIAJES ALAMEDA, S.A. assumes no liability whatsoever in the event that you contract services directly with the supplier.

V. VIAJES ALAMEDA, S.A. does not guarantee the accuracy or reliability of the content of this website.

VI. VIAJES ALAMEDA, S.A. does not guarantee that this website is free from viruses or the like and which may contain bugs or destructive properties.

VII. We shall make every effort to correct any possible errors or omissions as promptly as possible once we become aware of them.  However, as we operate with sophisticated technical means, obvious errors such as incorrect prices or promotions may sometimes appear.  In this event, we reserve the right to terminate the contract and you shall have the right to no compensation whatsoever. 

F) CONTACT
 
I. The method of contact between the users of our websites and VIAJES ALAMEDA, S.A. is by e-mail.

II. Any anticipated changes or cancellations with regard to the services contracted shall be notified to you at the e-mail address provided at the moment of booking, along with any other kind of information you may find useful.  Proof of sending the e-mail shall be considered as evidence of receipt. 

III. We strongly recommend that you read your e-mail prior to commencing your trip. 

IV. It is your responsability to verify that the e-mail address you have given us is correct and valid at all times.

G) CHANGES, AMENDMENTS AND CANCELLATIONS

I. The destination / pickup and accommodation address are as shown on your voucher. If you wish to change these or any other details you must do so on the "My Booking" section of the website or in writing by fax or e-mail addressed to the central reservation offices of VIAJES ALAMEDA, S.A. prior to the date of travel. Any amendments to a reservation is subject to an administration fee of Eur 10,00.

II. Any error that is observed once the contract has been formalised with VIAJES ALAMEDA, S.A. and at least 30 calendar days prior to the effective date of the contract must be notified to Customer care. If notification occurs once this period has elapsed, VIAJES ALAMEDA, S.A. reserves the right to terminate the contract and reimburse the customer with the amount paid after deducting an administration fee of Eur 10,00 per passenger and service plus the cancellation costs of the service supplier.
 
III. Any booking must be carried out directly at the "My Booking" section of the website or in writing by fax or e-mail addressed to the central reservations office of VIAJES ALAMEDA, S.A. at least 30 days prior to the date of travel. VIAJES ALAMEDA, S.A. shall refund you the money subject to a deduction of Eur 10,00 per passenger and service, as administrative fees. This administrative fee is independent of the cancellation policy of the service suppliers, meaning that this amount could be increased.

IV. VIAJES ALAMEDA, S.A. files the electronic document on which the contract has been formalised and this is accessible by the customer. 

H) IDENTIFICATION OF LIABILITY AND CAPACITY

I. You hereby declare that you are of legal age, in full use of your mental faculties with full legal capacity to answer for and accept the obligations of this agreement. 

II. You are aware of the services that are the object of this contract, the aforementioned information concerning VIAJES ALAMEDA, S.A., the content of the general conditions, and you hereby expressly waive the right to cancellation.

III. You hereby warrant that all the details provided to enter and use this Internet site are correct, complete, truthful and up-to-date.  Likewise, that the credit or debit cards that you use belong to you and that there are sufficient funds to cover the cost of the service.  You must notify us of any variation to the details that you have provided. 

IV. It is your responsibility to print out and check the confirmation of the transfer and/or accommodation contract and ensure that all of the details they contain are accurate, as the service contracted shall be provided in accordance with the details specified in the confirmation. If the details of the confirmation are incorrect you must contact VIAJES ALAMEDA Customer care immediately to rectify these.  VIAJES ALAMEDA, S.A. is not liable for any reservations you have made which are impossible to carry out and you shall not be reimbursed with the amount of the same.

I) TRANSFERS 

I. In the event of contracting a transfer, the driver shall wait a maximum of 60 minutes from the time of flight arrival. The waiting time from any other point shall be restricted to 20 minutes from the agreed time.

II. It is your responsibility to check the time agreed for pickup for your transfer service, as well as ensuring that the arrival time at the departure airport allows you to get there at least 10 minutes before the check-in desk opens (not closes) and under no circumstances less than two hours prior to the scheduled flight departure time.
 
III. VIAJES ALAMEDA, S.A. is not liable for delays due to force majeure, or to other circumstances that are unforeseeable or beyond our control, such as accidents suffered by third parties on the transfer route, police checkpoints, acts of terrorism or vandalism, extreme weather conditions, etc. 

IV. The arranged transfer shall be carried out between the points of origin and destination contracted. It is your responsibility to provide a sufficiently complete and accurate address that includes a street name and number. With private transfers, the vehicle shall take you to, or pick you up as close as possible to the accommodation, taking into account the physical characteristics of the vehicle and access to the contracted address.

V. In the event that access via the conventional route is closed due to weather conditions or the like, and you wish to be transported to your point of destination via a longer route, you shall be liable for any additional costs.

VI. All vehicles are covered by their owners with public liability insurance. 

VII. In the event of travelling with minors, this must be notified to VIAJES ALAMEDA, S.A. at the time of confirming the booking and you are obliged to use child safety systems during the transfer. 

VIII. Should you fail to notify VIAJES ALAMEDA, S.A. that you are travelling with minors, your transfer shall be subject to availability of seats in the vehicle and you must provide child safety systems during the transfer. In the event there are no seats available, VIAJES ALAMEDA, S.A. shall not refund the price of the service.

XIX. Those destinations that require the customer to call in order to reconfirm the trip are specified on the voucher. Should the customer fail to reconfirm the trip, VIAJES ALAMEDA, S.A. shall not provide the service and shall not refund the price of the service.

X. The users of VIAJES ALAMEDA, S.A. services have an emergency telephone number available 24 hours a day shown on their voucher.

XI. VIAJES ALAMEDA, S.A. is unable to guarantee the vehicle category in which the transfer shall be made, which may be replaced by another of a similar or higher category under all circumstances. 

J) BAGGAGE

I. All baggage must be properly labelled with the name of the owner and destination address.

II. Each passenger may carry one piece of baggage with a maximum weight of 20 kg (maximum combined size of 158cm) and hand luggage with a maximum weight of 5 kg (maximum dimensions of 45cm x 35cm x 20cm). 

III. Any excess baggage must be declared at the time of making a booking. The passenger shall be liable for all expenses incurred through contracting additional vehicles to transport non-declared excess baggage. 

IV. The customer hereby warrants that the following shall not be included in their baggage: objects that are susceptible to being hazardous for the remaining passengers; objects whose transportation is forbidden in accordance with current legislation; animals not included under point VIII; firearms and objects that we are given to understand cannot be transported due to their weight, size, nature, such as fragile or perishable objects, or those that are excessively voluminous.

V. VIAJES ALAMEDA, S.A. recommends you do not transport fragile or valuable objects such as jewellery, money, precious metals, items of silverware, cheques or other negotiable securities, documents, passports and other ID documents, samples, etc.

VI. The customer's baggage is transported under their exclusive responsibility and no claims shall be entertained for loss or damages to the baggage. We recommend that you take out adequate travel insurance to cover these eventualities.

VII. Baggage left on board the vehicle shall be sent to the address given to us by the customer and which shall be payable by the customer. 

VIII. Pets are carried under your exclusive responsibility.  They must travel in a container that satisfies IATA specifications. Pets can become very nervous during travel and all necessary precautions must therefore be taken. Under all circumstances you must notify VIAJES ALAMEDA, S.A. if pets are to be transported.

IX. The customer hereby accepts any possible additional charges for the transportation of pets by VIAJES ALAMEDA, S.A.
 
K) ADMINISTRATIVE FORMALITIES
 
I. You are solely responsible for carrying the necessary documentation for frontier crossing . VIAJES ALAMEDA, S.A. hereby refutes all liability and shall not incur any supplementary expenses caused by failure to carry these documents or for failure to observe customs, police, tax authorities or administrative rules of those countries where entry is required. The transport voucher is not a valid documentation to obtain entry visas. 

II. You are hereby obliged to reimburse us with payment for any kind of deposit or fine that VIAJES ALAMEDA, S.A. has to pay the Authorities of other countries through your failure to observe the laws, regulations, etc. or other travel requirements of those countries which you intend to enter or leave or pass through. In this event, we shall have the right to retain any amounts belonging to you until you have proven reimbursement.

L) RIGHT OF ADMITTANCE
 
I. VIAJES ALAMEDA, S.A. hereby reserves the right (and hereby delegates the right to the transfer service providers and their drivers) to refuse to transport any person that may be under the influence of alcohol, drugs and/or whose behaviour may be considered dangerous for the driver of the vehicle or other passengers.

II. No alcoholic drinks may be carried on board the vehicles for the purpose of consumption. This prohibition extends to narcotics.

III. Smoking is forbidden inside the vehicles.
 
M) ACCOMMODATION

I. Arrival and departure to and from the accommodation as well must be carried out in accordance with the guidelines given by the service supplier. Likewise your stay must adhere to conditions established by the accommodation.

N) INTELLECTUAL PROPERTY RIGHTS
 
I. Copyrights, trademarks and other intellectual property rights of the websites have been granted under licence to VIAJES ALAMEDA, S.A. and are protected by national and international regulations governing intellectual property. 

II. Any other use of our website content is prohibited, including the modification, subsequent publication, reproduction or total or partial representation of the same without the express consent of VIAJES ALAMEDA, S.A. 

III. You hereby undertake not to use our websites for unlawful purposes.

O) APPLICABLE LAW AND COMPETENT JURISDICTION

I. These General Conditions are subject to the provisions set forth in Spanish legislation, more specifically, Law 34/2002, dated 11 July, on Services on the Information Society and E-commerce; Law 7/1998, dated 13 April, on the General Contract Terms, Spanish Royal Decree 1906/1999, dated 17 December, on the General Conditions of Telephone or Electronic Services Contracts; Law 15/1999, dated 13 December, on the Protection of Personal Data, EC Directive 2000/31/EC of the European Parliament and Council, dated 8 June, Directive on electronic commerce, and Directive 97/7/EC of the European Parliament and Council, dated 20 May on the Protection of Consumers in respect to Distance Contracts.

II. The contract by and between VIAJES ALAMEDA, S.A. and the user shall be governed in accordance with Spanish legislation. 

III. Any controversy that may arise between the user and VIAJES ALAMEDA, S.A. shall be settled in accordance with Spanish jurisdiction and the courts of Benidorm (Alicante).

P) PRIVACY POLICY OF VIAJES ALAMEDA, S.A.

I. When the Internet user accesses a website of VIAJES ALAMEDA, S.A. they do so in an anonymous manner and are not registered for any online service.

II. The Internet user remains anonymous while they are carrying out a search for offers or reading general information contained on the VIAJES ALAMEDA, S.A. website, and are not registered for any online service.

III. VIAJES ALAMEDA, S.A. does, however, use cookies (user identifiers) on its websites to collect information on the website use. VII. Bear in mind that we do not provide your e-mail address to service suppliers.  However, we may send you offers in representation of these parties. Also remember that should you benefit from an offer from a service supplier provided by VIAJES ALAMEDA, S.A. and you become their customer, the suppliers may independently wish to send you offers. In this event you must notify them separately on whether or not you wish to receive their future offers. As an illustration of the types of special offers that we may provide on behalf of the service suppliers to customers of VIAJES ALAMEDA, S.A. our aim is to provide offers to persons we believe will find them useful. The offers are prepared and administered under strict conditions targeted at protecting security and confidentiality of the customer's personal details.  However, you may request us to cease sending offers at any given time.

VIII. VIAJES ALAMEDA, S.A. provides its clients with an easy way of rejecting the e-mail offers. Although some customers tell us that they like receiving information on these carefully designed opportunities, we recognise the importance of giving you options. You may choose not to receive these offers at any time by clicking on the appropriate place on the commercial correspondence you receive. All e-mail offers you receive from VIAJES ALAMEDA, S.A. will notify you on how to prevent future offers being sent by e-mail. Moreover, you may set or change your online e-mail preferences at any time.
 
IX. VIAJES ALAMEDA, S.A. hereby undertakes not to contract, provide services to or send offers to minors. 

X. In turn, minors must not register for any service provided by VIAJES ALAMEDA, S.A., even when they are browsing the Internet and access  the VIAJES ALAMEDA, S.A. websites. We likewise remind their legal representatives or guardians of their duty of vigilance with regard to minors and of their duty to immediately notify us if they become aware that a minor has registered for any kind of service provided by VIAJES ALAMEDA, S.A. to enable us to cancel the corresponding registration.

XI. In accordance with current legislation, we shall provide you with the information we have with regards to your personal details whenever requested. XIII. VIAJES ALAMEDA, S.A. hereby refutes all liability with regard to the content or conditions set forth in any other linked or affiliated website.

XIV. The changes to our Internet Confidentiality Declaration shall be noted herein, to enable you to be fully and permanently informed on our protection of your confidentiality and your choice with regards to our use of personal details for marketing purposes.
